it is 5:00 on the nose. thanks for getting up with us. good morning, everybody, i'm jon kelley. >> and i'm laura garcia-cannon. we were talking about the break we were going to get in the storm today. time to check in with meteorologist christina loren. >> good morning to you. yeah, we're still tracking some showers on the radar this morning. want to make sure you get up and at 'em this morning. give yourself plenty of time because even though it's not raining heavily, we still have a lot of aftermath from yesterday. trees, leaves all over the place and highway is slick in spots. we're getting a little rainfall to the north of santa rosa. that's where the showers will stay, north of the golden gate bridge at least the first part of the day. tonight this will really impact the south bay as we head through your morning commute tomorrow, expecting another rough drive. it looks like as we head throughout the next few days, we are going to get breaks. we'll time those out for you. your opportunities to get outdoors. we wanted to start and show you just how mild it is out there this morning. 58 in san francisco, close to 60

just about everywhere. headed towards the mid-60s today. a little bit warmer. we'll let you know when that rain returns and how much we're expecting. back to you guys for now. >> thank you. right now we are learning new details about some breaking news we've been following this morning. police officers and canine units right now in the middle of a manhunt on the peninsula. that is where marla tellez is live in palo alto where she just spoke with the police. marla, what's happening out there? >> reporter: good morning. palo alto police, i can tell you, really being quite quiet about this one so far because they say it's really too early in the investigation. here's what they do confirm to us. a woman woke up to find a man she did not know inside her apartment about 2:30 this morning. she called police, she screamed and that's when they say the suspect took off on foot. now the search for him continues. we want to give you a look at the scene right now. you can see it's still very active. crime scene tape surrounds this apartment dcomplex right at the intersection of high and hawthorne, about a mile and a

half from stanford university. police are inside collecting evidence right now and talking to neighbors. they say this sort of crime is rare and at this point they are treating this as a burglary. they don't actually know if anything inside was taken. they can confirm the victim is a woman in her 20s and they say she is not hurt. they are not ruling out the possibility she may have been sexually assaulted. >> she's currently safe with police officers unharmed and that's the good news. the best description i have right now is just a male wearing dark clothing. >> reporter: that's really all the information that they are telling us about this suspect. they do tell us, though, that officers are currently patrolling local area neighborhoods in this area looking for the suspect. again, they are speaking to neighbors. the victim, that woman in his 20s, is currently at the palo alto police department giving a statement. that's the latest from here.

marla tellez, "today in the bay." new this morning, tense moments in san francisco overnight as a standoff with s.w.a.t. officers lands a parolee behind bars. christie smith joins us live at the san francisco county jail with how it all came to an end overnight. good morning. >> reporter: good morning to you. that 24-year-old san francisco man is waking up in the county jail this morning. he just had been released from federal prison when out of the blue he had a violent run-in with san francisco police officers, but they were able to catch up with him thanks to an anonymous tip. he had barricaded himself inside a home on appleton street and officers had to use some flash bang devices before it ended. it started when officers on monterey boulevard spotted a man on federal parole with an outstanding warrant in a green

mustang. he sped off and hit a parole car. the officers were okay but the car was found abandoned across town. they searched for him but couldn't find him. then a break, a tip that he was inside a home. police brought out their negotiators, s.w.a.t. team to ending it peacefully. >> officers set up the perimeter, formulated a plan. once they made contact with the suspect, he surrendered peacefully. very fortunate that he did so. >> reporter: again, that man is from san francisco and police say he has gang ties. he was in prison for gun violations and he had failed to show up to a meeting with his parole officers. he was booked late last night so police are expected to release more information like his identity a little bit later this morning. reporting live in san francisco, christie smith, "today in the bay." right now we have new video from that los gatos, an armed jewelry store heist. we told you about this this week. two gunned masked gunmen raced

into the store on tuesday around noon. one of them holds an employee at gunpoint while the other one just smashing cases, grabbing the jewelry as fast as he can. after about a minute the two men finally take off out of the store. police right now still looking for them. it's 5:05 right now. parents with students at st. francis cabrini catholic school say they want changes after a convicted pedophile was allowed to volunteer at a school festival. the parish held an open forum to discuss how mark geries was allowed to be at the festival. he obtained a letter of permission from the diocese staff, something that never should have happened. the church says they hope this meeting will help the community move forward. a memorial fund has been set up to help the san bruno family of two sisters killed in a tragic car crash that happened last week. 24-year-old and 20-year-old were

both sadly killed when the suv their father was driving slammed right in the back of a chp patrol car, which was pulled over on highway 1 near the oregon expressway exit. both sisters were thrown from the suv as it flipped over several times. their mother remains in critical condition this morning. this online memorial fund was created by one of the former high school classmates and has already raised nearly $7,000 for the family. it's 5:06. a contra costa school district taking action to keep students in school. the west contra costa school district has developed a pilot plan to reduce school suspensions by 25%. the district says it's losing funding because too many students are cutting class. the pilot plan is being used at kennedy high school in richmond and includes drug and alcohol counseling and a suspension room where suspended students can still do their homework during the day. it is 5:07 right now.

things are calming down a little bit outside but christina loren is still taking her vitamins and her wheaties because it's going to get busy fast. >> it certainly is, jon and laura. i just wanted to point out some of the more significant storm reports from yesterday and this is the first of a series of storms. already saturated ground means more of these will come out. the most impressive power outage was pacifica. mt. diablo clocked a 66-mile-per-hour wind gust. close to 80 miles per hour high atop mt. hamilton and we had power lines on highway 9 in the santa cruz mountains. minor flooding in alameda county. so far the flooding has been minor but we're not going to have a long dryout period before the next round of heavy rain arrives so we are expecting more flooding reports the next couple of days. we'll keep you updated right here on nbc bay area. we do have some showers on the radar this morning. nothing too heavy just yet. the heavy rain stays offshore, at least until we head through

tonight here in the bay area. this fronting is going to be more of a traditional fronting, moving through the north bay and slowly progressing to the south and south bay as we wake up tomorrow morning. right in the heart of your morning commute it will be nice and sloppy so give yourself extra time and plan on leaving early tomorrow. 65 in livermore, 65 in santa teresa, we'll hit about 63 in san jose. so temperatures overall running a little warmer than yesterday afternoon. this dry break doesn't last long. we'll time out that system when the rain will return to your city in my next report. that seven-day outlook reveals when you'll get to be out in the sunshine. that's in the seven-day coming up. let's which can your drive with mike. we're looking over here to the bay bridge where there were three cars pulled over to the side. they have since cleared in the last five minutes. also clearing, the puddling and the ponding we saw yesterday, so drier roads here but still some patches, especially the north bay, with some slick conditions. the camera is okay here but let's look at the emeryville camera because chp issued a wind advisory for the bay bridge span and here at the emeryville

camera we can see it shaking as bell. the breeze hitting folks on the flat section and definitely across that s curve just after the incline so watch that. smooth drive through berkeley, though. oakland also moves nicely after the earlier accident cleared just north of the coliseum. circling construction but no slowing through that area. we do have the warriors game tonight. there's typical congestion around the parking lot and also that's about the same time the rain is coming in so keep that in mind as you travel through oakland, 880 will get tougher to drive especially past high street. a live look across the bay and we'll see palo alto. no problems on the peninsula. i'll give you a wider view and the south bay check coming up, guys. back to you. it's 5:10. history could be made in the middle east today. the key vote just hours from now that could change the makeup of the middle east peace talks. the groupon ceo could find his job cut today and bologna is

well, today is a big day for groupon's young ceo andrew mason. scott mcgrew said the man who once turned down $6 billion from google may be out of a job. >> yeah, groupon's board will meet today in chicago. according to several reports, the top of the agenda will be deciding whether to fire the guy who founded the company, andrew mason, seen here in the center there just a year ago at the top of his game as he opened the nasdaq after groupon's ipo. now, at the time last november, this was the largest tech ipo since google. the stock has fallen 80% since. now, mason tells reuters, quote, if i ever thought i wasn't the right guy for the job, i'd be the first person to fire myself.

that same shareholder who sued hewlett-packard over its calm kael bad purchase of autonomy is now suing the accounting firms which signed off on the deal. the papers were filed in san jose federal court yesterday. kpmg offered a bewildered response saying it was never involved in the deal. about the only good thing in the fiscal cliff is it keeps greece out of the news. let's turn to bertha coombs live at cnbc world headquarters. >> reporter: yeah, we seem to live and die by the headlines, whether the talk is happy or not coming out of washington but retailers will be in focus as they report their november sales today. despite the strong start to the holiday season, analysts expect sales to be 1.6% rise. the east coast will have a big impact from hurricane sandy. we've got target and macy's both below expectations.

but on a high note small businesses hit it big on cyber monday. the digital research firm big commerce said a surge in orders drove overall revenue for small chains and mom and pop stores up 25%. the average order price was also 8% higher. online shoppers bought so much stuff local retailers were averaging about two orders per second and that is about four times the normal daily volume. but i don't know, i like shopping in store at a small boutique, mom and pop store, but i do shop online for the big department stores. maybe i'm alone on that. >> well, we're a growing minority. all right, bertha coombs, thank you much. we try to hold a high standard here and jon just pointed out i made a mistake on that groupon where it says 2001 on the video i just showed you a minute ago. it makes me feel a little silly when i point out somebody else's mistake. yahoo!'s ceo marissa mayer at fortune, this was yesterday.

yesterday they misspelled miss mayer's name. the problem with this here is that her name is m-a-y-e-r like the bologna. she said people have had trouble with her name ever since john mayer started singing. he's -- anyway, people mispronounced his name and misspell it and misspell hers as well. >> i'm going to have that song in my head all day, scott, thanks. >> you're talking about my body is a wonderland. >> i'm sure many would agree, christina. >> agree that your body is a wonder lady, my bad. good morning to you. it's going to be kind of rough as we head through the next few days. i want to start just to the south of tracy. look at that, little pop-up storm this morning. we don't have any widespread activity when it comes to thunderstorm development and we're not expecting that.

as we head through the next 12 hours, we're looking rather stable, rather quiet but a storm system on the way. we're going to get another round of heavy rain that will take its time approaching the coast of the bay area. we're waiting on that until 5:00 p.m. tonight. futurecast agrees with me on this. south-southeast winds still pretty strong in oakland at 14 miles per hour sustained. we're sustained at 10 in san jose so the winds are below advisory criteria but still strong enough to knock you around. stronger gusts at 25, 35 miles per hour could make for a rough drive over open water bridges this morning. time out this next system. we're looking really good. at 10:00 mostly cloudy conditions. showers to the north of the north bay. the heavier rain will arrive as we head through 5:00 p.m. through 5:00 a.m. tomorrow. we're looking toward a really rough commute. the one thing all these storm systems have in common, the heavier rain comes down overnight into the morning hours which is not so great for the early morning commuters but typically the afternoon rush is a little heavier and so you are

getting a bit of a break in that department. it could be miserable as you get off work. so we stop the clock at 9:00 a.m. friday morning. still getting that heavy rain from concord to antioch. then we get a little bit of a break the second half of friday. then by 9:00 a.m. saturday it gets active yet again. we'll bring in that next heavy wave of moisture on 2:00 a.m. on sunday. and sunday's storm is packing quite a bit of rainfall. this is the day that we're expecting those flood reports to come in droves so you want to keep that in mind. we're going to be watching it for you here at nbc bay area. our whole weather team is on high alert. 64 degrees in livermore, 62 in concord and 65 in san francisco. as we head throughout today, this is basically the driest day in the extended period. friday into saturday those periods of rain come through. by sunday a.m. rain will make way to partial clearing. tuesday and wednesday, another system tries to move into the bay area. i think we're going to get 30%

to 40% chances for rain as we head through the second half of wednesday into thursday so not a whole lot of drying time between a system. we want you to keep it in mind. let's check on the drive. 5:18. good morning, mike. >> good morning. the roads have had time to dry out. the yellow you see, speeds coming down towards 60 but not a major concern. the volume very light. 101 here at 280 and 87 still moving smoothly. the volume just starting to build throughout these northbound commute routes. as you're coming up the peninsula, also very nice for 101 and 280 at the bottom of your screen, not a problem this morning. we're looking at the dumbarton but no slowing across the span. that's it for 84. we'll jump over to the tri-valley. we're looking at folks coming out of the altamont. there's slowing there, pretty traditional pattern for a thursday but an easy drive through the dublin interchange and south 680 through sunol and back into the south bay. we'll look at 580 through the castro valley y. you're okay. if you're heading to the san

mateo bridge, 92 westbound with these taillights across the flat section, there's the high rise clearly visible. might get caught with a gust or two but it's okay right now as far as the speeds and flow. here southbound 101. north 121 at pope valley there's an accident chp reports but it sounds like things are pretty calm and they may have the closures completely cleared up. also a little water right here, you see that as you get here right by that bus and so still have patches of puddling in the north bay and more rain coming, christina says, so watch that, guys. back to you. 5:19. happening now, a tense standoff continues this morning after animal control officers shot and killed near sacramento. sheriff's deputies say the armed suspect holed up inside this home about 20 miles south of sacramento. the man allegedly fired a shot through his front door yesterday afternoon, killing an animal control officer who had come to his home to pick up several dogs and cats.

the suspect was evicted from a home a day earlier and had complained he had nowhere to take his animals. sheriff deputies have fired gas canisters into the home but so far have been unsuccessful in getting the suspect to surrender. several homes nearby have also been evacuated. on the international scene, the united nations today voting to decide whether palestine should be recognized as its own country. the resolution would change palestine's status from entity to nonmember state. that means palestine would have access to more international resources, including international criminal courts. now the expectation is it will pass very easily. both the u.s. and israel, however, have said they will vote no and have threatened to withhold funding for the west bank government if the resolution passes. a new study finds guantanamo bay detainees would be just fine in u.s. jails. senator dianne feinstein, who shares the senate intelligence committee, says the government

report shows moving gitmo detainees to the u.s. would not hurt national security. u.s. prisons apparently hold 373 prisoners convicted of terrorism and there are no major problems. there are 166 detainees at guantanamo bay. 5:21 right now. coming up, a brand new movie about the shooting of oscar grant about to debut at a major film festival. we'll tell you which oscar winner is slated to star in that flick. welcome back, everybody, on this thursday morning. right now a live look spanning over san jose before the sun comes up. it looks like it's going to be some calmer weather out there today before it gets rough again tomorrow. christina loren will be along to fill you in. it is 5:24. the saga of the oscar grant shooting all set to play out on the big screen. that will be happening at the

sundance film festival and it will screen fruitvale, that is a movie detailing grant's final hours before he was shot and killed by police officer johannes mehserle. octavia spencer will star and oscar grant is played by michael b. jordan. the sundance film festival is set to start january 17th. secret talks between the nhl and the players association will resume this morning. the two sides met with a federal mediator yesterday to try to end the lockout that has lasted two months. while there's no word on where negotiations stand, things went well enough to warrant another day of talks. the nhl has cancelled games through december 14th. >> keep your fingers crossed at least by the new year they get things back into action. we go from the lockout to some gridlock or maybe lack thereof. mike inouye is here to tell us -- oh, we're going to weather

meteorologist christina loren. she has a look at when. >> yeah, good morning to you. we're going to get about a 12-hour break, especially here in the south bay, but the heavy rain is on the way as we head throughout tonight and then we're expecting the heaviest part of this next storm to arrive just in time for your morning commute tomorrow so expect another rough drive to work. we'll be here to guide you through it and everybody traveled relatively cautiously yesterday. we didn't have a lot of accidents so that's the good news. we appreciate you all heeding our warnings. the ground is already saturated in parts of the bay area and look at what's to come tonight through tomorrow morning. a lot more rain when we meet back here. we'll be tracking this for you. right now i'll send it back to you and rest of the top stories of the day. >> right now we want to update you on breaking news out of palo alto where a manhunt continues before. police say a man got into a woman's apartment on hawthorne and this all happened just two miles away from stanford university. marla tellez is live at the scene with all the details. marla, good morning. >> reporter: jon, good morning. police tell us they are going to

be here on scene for at least a couple of hours while they collect evidence and they talk to neighbors at this apartment complex where this incident tack place earlier this morning. now, you mentioned we're on hawthorne street. the intersection is high, less than a mile and a half from stanford. in fact not far at all from university avenue. we all know how very busy and popular that is. what i'm trying to say, this is a pretty good neighborhood. police tell us they are looking for a male suspect wearing dark clothing. at this point that is the limited description they are giving us. what they do tell us is it all happened about 2:20 this morning. a woman in her 20s woke to find a man inside her apartment. that's when we she called 911. >> an unknown male made entry into this woman's apartment. she woke up to find the male intruder inside her apartment. she screamed, out of fear obviously, and he ran away. he fled the scene.

>> officer young there tells us they have already conducted a canine search in this area but that did not turn up anything. he also says the best news here is that the woman was not hurt. in fact he says that right now she is safe and sound with police at the local police department giving a current statement. in the meantime, the investigation out here at high and hawthorne continues. they are patrolling local neighborhoods searching for this suspect. as for public safety, they are treating this as an isolated incident. live in palo alto, marla tellez, "today in the bay." new this morning, an overnight garage fire uncovers a small marijuana grow in san jose. firefighters just leaving the home. a person living inside the home called to report the fire about 2:00 this morning. when fire crews arrived, they found five marijuana plants on fire. as of now no arrests have been made. the man who lives at the home says he has a medical marijuana

card for his health problems and was growing the pot to treat a number of different ailments. fire crews say an overloaded circuit may have sparked the fire. in oakland right now, a search is under way this morning for a 16-year-old girl considered at risk. cheyenne white walked away from a group home tuesday night. she was last seen near the intersection of international boulevard and 34th avenue. that's just one block away from the fruitvale b.a.r.t. station. cheyenne is being considered at risk because police say although she's 16 years old, she has the mental capacity of a 9 to 12-year-old. anybody with information on this case is asked to please call oak laen land police. >> a. parolee is behind bars after a tense standoff with police officers overnight. christie smith is live with the explosive ending to a very dangerous situation. good morning, christie. >> reporter: good morning to you, laura. what a night for san francisco police. they tried to stop a wanted

federal parolee that they spotted on the streets, but he ended up plowing into their patrol car as he tried to get away from them. they caught up with him hours later and arrested him, but it didn't come easy. s.w.a.t. officers had to use a flash bang device as they received a tip that this man, who had just been released from federal prison, was in a home on appleton street. they had been searching for him for hours. it started late afternoon on monterey boulevard when officers spotted this guy and knew he was wanted. he apparently didn't meet his parole officers. but he sped off, hit that patrol car. fortunately those officers were okay but police tried to find him, they couldn't, until they got that tip. >> officers from englewood station responded to the area. they were able to confirm the presence of a suspect in that residence and called in a tactical team. the tactical team and crisis negotiators responded to the

scene. a perimeter was set up. when the police department made contact with that suspect, he surrendered peacefully without further incident. >> the man is 24 years old from san francisco. police tell us that he has gang ties. he was last in prison for firearms violations and of course he's waking up this morning here in the county jail in san francisco. because he was arrested so late in the evening, though, investigators are expected to release more information later this morning, including his name. reporting live in san francisco, christie smith, "today in the bay." it is 5:35 right now. closed door meetings about the safety of the new bay area bridge may be open to the public. officials will work with lawmakers to improve public access. senators say they're concerned because the panelists meet in private and have financial and professional ties to caltrans. nothing to hide when it comes to that forecast. meteorologist christina loren

keeping tabs on it this morning. >> if i hide it, then it gets posted on my facebook page, why didn't you tell you it was going to rain? well, i'm going to do my best right now. we do have some light showers coming down north of san francisco. that extends all wait north to santa rosa. that will be the deal for the first part of the day. the heavier rain arrives. it's going to take its time slowly moving southward into the bay area. that will continue through about 5:00 a.m. tomorrow morning so with about 11 to 12 hours of heavy rainfall over parts of the bay area, you can imagine waking up tomorrow. it's going to be rough getting to work. we'll continue that heavy shower chance all the way through 10:00 a.m. tomorrow and then showers will break apart. we'll get a nice-looking second half of the day and so it's the same deal. showers arriving just in time for the morning commute, clearing out for the evening. we'll see enough sunshine to boost our numbers up a little bit from yesterday. 64 in fremont, 63 in san jose and it's pretty mild out there.

temperatures in the 60s right now in parts of the bay area. we'll take you through your full forecast and time out the series of storms on the way. more rain in the middle of next week. 5:37. first let's talk to mike about your morning drive. >> hey, folks, we'll look at the bay bridge, the incline now. the taillights going up toward treasure island and the smooth drive, nice spacing but more cars. the big issue is chp has given a travel advisory overnight and continue it for the bay bridge and maybe gusty winds at times. as christie smith explained yesterday, some scientific method they have people who drive across the bridge and call in and say, hey, it's kind of windy. that's what you're going to experience as well. we'll looking at the maps and the approach moves smoothly coming out of the maze. the area i've circled, the area for that wind advisory but construction crews clearingn 880 through oakland and also the approach to san francisco without much problem. an easy drive out of the north bay via the carquinez bridge or

welcome back, everyone. 5:41. top white house negotiators head to capitol hill today to continue talks about avoiding the fiscal cliff. tracie potts joins us live on capitol hill where the meetings will take place. good morning. >> reporter: good morning. one of the key players today will be the bay area's own nancy pelosi. the minority leader now on the house side, her job will be to try to not only come to some sort of agreement with the

leadership, but then convince the rest of the democrats in the house that this is a good deal, but we are far from that right now. what's happening today, white house negotiators, tim geithner, the treasury secretary and the white house legislative chair coming here to capitol hill to work with pelosi, john boehner, mitch mcconnell and harry reid to try to get some understanding of what the white house is willing to do here. republicans say what they want to hear is what budget cuts, what spending cuts is the white house, the president, are democrats willing to make. in other words, as boehner put it, if we're going to put new revenue on the table, something we didn't want to do, we want to see some details on spending cuts. so those one-on-one meetings with the leadership going on here today, and that's really the latest in what's been a long string of developments leading toward trying to avoid the fiscal cliff at the end of the year. >> we will see what happens. thank you very much, tracie.

5:43. new this morning, a mountain climber is oregon is safe after an overnight rescue operation. the climber was on his way down after summiting mt. hood when he was stranded in a snowstorm yesterday afternoon. he was able to call search and rescue on his cell phone. he wasn't hurt but certainly was cold and wet. rescuers were able to bring him food and dry clothes before bringing him down to safety. as meteorologist christina loren has been reporting all morning long, another round of wet weather is moving right into the bay area. a lot of people are getting ready. bob redell is live in san jose with more on this story. bob, good morning. >> reporter: throughout the bay area, yeah, good morning to you, jon, we have two more storms that are coming to the bay area. one will hit the north bay later this afternoon, slowly make its way down here to the south bay. lingering until saturday afternoon when the second storm is expected to hit. so the question is will you need

to be here to pick up sand bags. if you live in an area that typically floods, then the answer is possibly yes. our meteorologists predict that there will be a risk of flooding along some creeks or if you live on a street that typically drains slowly, that could be an issue because we are getting hit back-to-back by these storms n places like san jose, city workers have checked every one of the city's 26 storm water pumps here in san jose to make sure they're working. they did this yesterday, just to make sure they're working okay and ready to pump out rainwater from low-lying areas. >> certainly we're prepared for it so in the event that it does get more severe we have cruise on stand by, crews really to go and be there to respond. >> reporter: now, yesterday we also had that storm. the damage from it was minimal. we had a few downed trees throughout the area, power lines down and some car accidents, but it was nothing in terms of overly destructive. again, you can check with your local agencies to see if they have sandbags. if you think you're in an area

that you would need them. here in the south bay, santa clara water districts will hand out sandbags. most areas do provide these free of charge. reporting live here in san jose, bob redell, "today in the bay." >> all right, so a little bit of a break to get our affairs in order. >> cut loose soon? >> it's going to cut loose and you know what, we're not going to get out of the rain. even next week on wednesday we have more rain. debbie downer, you're looking at her. good morning to you. temperatures right now are pretty good. they're actually rather mild. we're in the 50s and 60s. yeah, grab your umbrella. just because it's not raining heavily right now, it will be by about 5:00 p.m. in the north bay and those showers will move to the south as we head through the overnight showers. so i'm going to time this out for you but this is what's on the way. a lot of this will start to weaken as the front moves onshore in the bay area. it's going to lose a lot of energy as it continues to progress south. we stop the clock for you.

at 5:00 a.m. when we meet back here this is what you have to drive to work with, heavy pockets all the way throughout the bay area. stop it again at 10:00, that's when the heavier rain will let up. between 10:00 and 5:00, we'll get dry breaks but those light on and off intermittent showers will continue. like i've been saying the heavier rain arrives overnight while you're sleeping for the most part but that means slick conditions for the early morning drive. if you have to commute to work saturday morning, it will be a little bit on the rough side. we stop that clock for you again as we head through 6:00 p.m. saturday. that's when our next round of heavy rain returns and that's going to really pick up the first part of sunday, but you'll have an opportunity to get outdoors sunday afternoon. look at some of these totals. i told you, we've got more rain on the way tuesday into wednesday. that's going to bring your totals up closer to 8 to 9 inches from the original 7 inches we were thinking because we already have an inch on the ground in places like the north bay. throughout the day today, this

that throw. to the tri-valley, we know this yellow and orange is going to stick around. that's coming into livermore and toward the dublin interchange. no accidents for west 580 or south 680. that's smooth through pleasanton and sunol. a look at the bay bridge, another typical congestion spot. we have cash lanes starting to back up a few cars deep. fastrak good advantage. here no problems down the east shore freeway, that's west 80 for folks. peninsula side we're looking at palo alto and this represents 101 and 280. the volume builds but no problems for the slowing. north bay, 101, that's where the buildup happens and there's still a little water on the roads. keep that in mind, some slick conditions possible, guys. back to you. it's 5:49. a can of bear spray and a vigilant homeowner who had it helped nab a man accused of stealing packages off of people's front porches. that man, who targeted san francisco's neighborhood for months, will be in court later

today. people living in the area say they have been trying to get him for a while, even snapping photos of him, but it was never enough for an arrest. >> if you add up all the package that say just people on this block alone have lost, it's, you know, it's quite a number and it's quite frustrating. >> one neighbor took matters into her own hands, setting up a camera and arming herself with bear spray. the blog posted the video that shows that man opening the gate, taking a package. another video on the site shows a woman chasing after him dousing him with that bear spray. police say 51-year-old andy andua was arrested with oerj be -- orange bear spray on this is face. we know the end of the year comes with all those lists, top this, top that. how about gq's list of least influential people of 2012. now, the magazine calls the list a collection of people so uninspiring that we should round them all up and stick them on an iceberg. high praise, huh?

facebook put their friends at risk. scott mcglue takes a sip of coffee as we're doing a little math. >> everybody gets coffee because we're going to do math. it's only addition. but here's the problem. kids sometimes lie about their age to get on facebook. they're supposed to be thern. so a 10-year-old may lie and say he's 13. five years later, that kid is 15 and all of his friends are on facebook legitimately, but remember he didn't tell the truth about his age so facebook thinks he's 18. he's not an adult, but facebook thinks he is. and then according to the study by new york university, facebook starts turning off some of the protection. not just for him but to access his list of friends, because remember facebook thinks it's dealing with an adult. consumer reports recently estimated there are at least five million kids under the age of 13 on facebook lying about their age. speaking of computer high jinx, the guy who drives the
